TERMS AND CONDITIONS
This page sets out the terms and conditions the client must agree to when working with Book Cover by Design Ltd. They are designed to make the process of working together fair and reasonable for both designer and client.
CONFIDENTIALITY
All the information that the client shares with us is considered confidential, and will only be used by Book Cover by Design Ltd to provide our best services, and to complete the design of the book cover. We will not share this information with any third party, unless requested to do so by our client.
RIGHTS
When full payment is received, Book Cover by Design Ltd will grant the client exclusive license for the final cover design. We will provide the design in JPEG, PNG and PDF where needed. Allow up to 48 hours for all finished files to be transferred to you.
The client agrees that they have no right to alter the completed design in any way. Book Cover by Design Ltd will not provide the client with psd source files.
IMAGE USAGE
Client must abide by the terms of the license agreement for the images used in the cover design, which have been purchased by Book Cover by Design Ltd for use on the design.
The cost of cover design includes the license to use these images and is limited to a print run of 250,000 units and e-book of 500,00 units. If necessary, this 250,00/500,000 limit can be extended, for an additional cost. It is the client’s responsibility to inform Book Cover by Design Ltd if this is the case.
Client may supply their own images but they must meet specifications set out by Book Cover by Design Ltd. Book Cover by Design Ltd has the right to know where the image originated from, and we may ask to see your license agreement.
No items such as cups, bookmarks, t-shirts, pens etc. made with the finished book design may be sold. These items may be given away for promotional purposes only.
COMMUNICATION
Book Cover by Design Ltd is a UK based company so please allow for time differences, we try to reply within 48 hours to all communications, but over busy periods this maybe longer.
TIMESCALE
New orders take around 2 to 3 weeks, but over busy period may take up to 4 to 6 weeks. Book Cover by Design Ltd will let you know at the time of ordering.
Updates to existing orders can take up to 2 weeks depending on work load and may be subject to extra fees.
PDF Printable wraps sizing normally completed within 1 week.
SAMPLES
Book Cover by Design Ltd will supply up to 3 samples. If more new samples are required a non-refundable fee of £10 will be charged per sample design.
If the client likes a sample but wishes to make changes to small elements of that sample, Book Cover by Design Ltd will make amendments up to 5 times, anything after this will incur a non-refundable fee of £10.
Samples will only be held for a month without payment after that the design will go up for sale as a pre-made design.
CLIENT RESPONSIBILITIES
It is the client’s responsibility to order a proof copy of their cover design from their printer before putting their book on sale. In the case of any problems or expenses incurred by the client in relation to using the cover design, Book Cover by Design Ltd will take no financial or legal responsibility for this.
The client must provide the final size for their print cover, this includes where they are being printed, trim size, paper colour and final page count. The client may be asked to supply a template for some printers. If any of the information supplied by the client is incorrect or gets changed there will be an additional charge of £25.
PAYMENT
No payment is taken until after the final proof has been approved by the client. Once final payment has been received, Book Cover by Design Ltd regards this as final approval of the overall design, and the contract to be fulfilled. No amendments will be made to the design or text after this time, except for the blurb if the client has not supplied it. Any changes or updates will have an update fee of £10 per file. Book Cover by Design Ltd will not refund any funds paid to them.
Book Cover by Design Ltd takes payments via PayPal.com and Direct Bank Transfer. Client will pay any additional bank charges if they occur. If an author request a refund at anytime after the cover has been handed over, they will be not be allowed rights to that design and must stop using it. The author will have 24 Hours to remove the cover other wise a charge of £20 a day will be charged until the design is removed.
DISCLAIMER
Book Cover by Design Ltd makes no warranties of any kind, express or implied, for any and all products and/or services it supplies. Book Cover by Design Ltd will not be held responsible for any and all damages resulting from products and/or services it supplies. Book Cover by Design Ltd is not responsible for any loss, or consequential loss of data, or non-delivery of products or services, of whatever cause. While we take reasonable steps to investigate the materials we recommend, we accept no responsibility for the performance or quality of materials or any consequential loss arising from their failure. The customer agrees not to hold Book Cover by Design Ltd responsible for any such loss or damage. Any claim against Book Cover by Design Ltd shall be limited to the relevant fee(s) paid by the customer.
GENERAL
These Terms and Conditions supersede any previous Terms and Conditions distributed in any form. Book Cover by Design Ltd reserves the right to change any rates and any of the Terms and Conditions at any time and without prior notice. Book Cover by Design Ltd can refuse to work with anyone or stop work on any design at any time.
